Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of terpsbudwash.com and terpsusa.com (the “Site”) and your purchase or use of TerpsUSA Bud Wash and related products (the “Products”) from Terps USA LLC (“Terps USA,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase the Products.

Who Can Use the Site

Eligibility

You must be at least 21 years old to purchase Products from the Site. By placing an order, you represent and warrant that you meet this age requirement and that you are legally permitted to purchase and use agricultural/horticultural wash products in your jurisdiction.

🌎Jurisdiction

TerpsUSA Bud Wash is a post-harvest agricultural wash concentrate. It is your responsibility to confirm that purchase, possession, and use of the Product is lawful in your state, locality, and any applicable cultivation license or regulatory framework. We reserve the right to refuse or cancel orders where we believe use may violate applicable law.

Site Conduct

Use of the Site

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to the Site, other accounts, or our systems
Copy, reproduce, or resell content from the Site without written permission
Interfere with the proper functioning of the Site, including through malware, scraping, or excessive automated requests
Submit false, misleading, or fraudulent information, including in connection with orders or age verification

Purchasing

Orders, Pricing & Payment

All orders are subject to acceptance and product availability. We reserve the right to limit quantities, refuse any order, or cancel orders at our discretion, including for suspected fraud or pricing errors. Prices are listed in U.S. dollars and are subject to change without notice; the price charged will be the price displayed at the time your order is placed. Payment is processed through our third-party payment processor at the time of purchase.

Fulfillment

Shipping, Returns & Refunds

Shipping	Free shipping on orders over $50. Product is formulated below the UN 2984 hazmat threshold at 7.5% concentration; carrier availability and delivery times may vary by destination and are not guaranteed.
Returns	Unopened, unused Products may be eligible for return within a reasonable period of delivery. Contact contact@terpsusa.com to initiate a return.
Refunds	Approved refunds are issued to the original payment method. Shipping costs are generally non-refundable unless the return is due to our error.
Damaged/Incorrect Orders	Report damaged or incorrect shipments within 7 days of delivery for resolution.

Product Disclaimers

Is TerpsUSA Bud Wash a guarantee against contamination?

No. TerpsUSA Bud Wash is a post-harvest decontamination concentrate designed to help reduce surface microbial load when used as directed. It is not a guarantee that treated flower will pass any specific compliance, laboratory, or regulatory test, and results may vary based on cultivation conditions, contamination severity, and adherence to the wash protocol.

Does the Product remove mycotoxins?

No. As described on the Site, mycotoxins are stable compounds that are not removed by reducing surface microbial organisms. The Product is intended to support prevention of microbial growth, not to remediate mycotoxins already present.

Is the Product intended for medical use?

No. The Product is not a drug, medicine, or dietary supplement, and no claims on the Site are intended to diagnose, treat, cure, or prevent any disease. Statements regarding cultivation, compliance, or economic outcomes are general information, not professional, legal, or regulatory advice specific to your operation.

Ownership

Intellectual Property

All content on the Site — including text, graphics, logos, product formulations, and design — is owned by Terps USA LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

Risk Allocation

Limitation of Liability

To the fullest extent permitted by law, Terps USA LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost crops or harvests, or business interruption, arising from your use of the Site or the Products, even if advised of the possibility of such damages. Our total liability for any claim relating to the Products or Site is limited to the amount you paid for the applicable Product.

Your Responsibility

Indemnification

You agree to indemnify and hold harmless Terps USA LLC from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your use or misuse of the Products, or your violation of these Terms or applicable law.

Legal Framework

Governing Law & Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, unless otherwise required by applicable law in your jurisdiction. Any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Denver, Colorado, unless applicable law provides otherwise.

Changes to These Terms

We may revise these Terms from time to time. Updates will be posted on this page with a new “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
